Please read these Terms of Service carefully before purchasing a website plan from InkThorn Crustacean. By subscribing to any of our plans or using our services, you agree to be bound by these terms.
InkThorn Crustacean ("we," "us," "our") is a web development service operated by InkThorn.ai, based in New Orleans, Louisiana. We build and maintain professional websites for small businesses, with a focus on New Orleans-area businesses. Our contact email is admin@inkthorn.ai.
We provide the following services under monthly or annual subscription plans:
Services are provided on a subscription basis — monthly or annual — as selected at checkout. Pricing is displayed on our website at inkthorn.ai/crustacean and is subject to change with 30 days' notice to existing subscribers.
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel. You are responsible for keeping your payment information current.
Annual plans are billed in full at the start of each subscription year. Annual subscriptions are non-refundable after the 14-day money-back guarantee period, except as required by law.
We may build a preview website for your business using publicly available information (Google Maps data, business name, address, phone number, photos, hours, and category) before you subscribe. This preview is provided at no charge as a demonstration of our service. You are under no obligation to subscribe. If you subscribe, you authorize us to use this information to build and maintain your website. If you do not subscribe, your preview may be removed at our discretion.
You may cancel your subscription at any time by emailing admin@inkthorn.ai. Your service will remain active until the end of your current billing period. We do not charge cancellation fees.
If you are not satisfied with your website for any reason, you may request a full refund within 14 days of your initial subscription purchase by emailing admin@inkthorn.ai. This guarantee applies to your first subscription period only.
Upon cancellation, we will provide you with an export of all website content (text, images, and page structure) upon request, at no charge, within 5 business days.
By responding to an InkThorn SMS outreach message (other than with "STOP"), you consent to receive follow-up SMS messages from InkThorn Crustacean regarding our web development services. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help, reply HELP or email admin@inkthorn.ai. We will not sell your phone number to third parties.
You retain ownership of any content you provide to us (logos, photos, text, etc.). By providing content, you grant us a license to use it solely for the purpose of building and maintaining your website.
Upon active subscription, you have a license to use the website we build for you. The underlying templates, code, and design systems remain the intellectual property of InkThorn.ai. Upon cancellation, this license ends, though we will provide a content export as described in Section 5.3.
We use publicly available business information (from Google Maps and similar sources) to build website previews. You represent that your business information on those platforms is accurate and that you are authorized to use it.
You agree not to use our services to host content that is illegal, defamatory, harassing, fraudulent, or that infringes on the intellectual property rights of others. We reserve the right to suspend or terminate service for violations of this policy.
Our services are provided "as is." We make no guarantees regarding search engine rankings, AI discoverability, revenue, or business outcomes. GEO optimization follows current best practices but we cannot guarantee specific results from AI assistants or search engines, as those systems change independently of our work.
To the maximum extent permitted by law, InkThorn.ai's total liability to you for any claim arising from these terms or our services shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
These terms are governed by the laws of the State of Louisiana. Any disputes shall be resolved in the courts of Orleans Parish, Louisiana.
We may update these terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
